ORDER:
Whereas, by section 101 of the Andhra Pradesh Reorganization Act, 2014, the appropriate Government i.e., the State of Telangana is empowered by order, to make such adaptation and modifications of any law made before 02.06.2014,
whether by way of repeal or amendment as may be necessary or expedient, for the purpose of facilitating the application of such law in relation to the State of Telangana, before expiration of two years from 02.06.2014, and thereupon every such law shall have effect subject to the adaptation and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority;
And whereas, it has become necessary to adapt and modify the NTR University of Health Sciences Act, 1986 (Act No.6 of 1986) in force as on 02.06.2014 for the purpose of facilitating its application in relation to the State of Telangana;
Accordingly, the following Notification will be published in an Extraordinary issue of Telangana State Gazette:
NOTIFICATION
In exercise of powers conferred by section 101 of the Andhra Pradesh Reorganization Act, 2014 (Central Act No.6 of 2014), the Governor of Telangana hereby makes the following Order, namely:-
- (1) This Order may be called the NTR University of Health Sciences Act, 1986 (Telangana Adaptation) Order, 2014.
(2) It shall be deemed to have come into force with effect from 27/09/2014 - The Andhra Pradesh General Clauses Act, 1891 (Act No.1 of 1891), shall apply for the interpretation of this Order as it applies for the interpretation of a State Act.
- For the purpose of this Order and the Act adapted herein, the expression
“the State” shall have the meaning and areas specified in section 3 of the Andhra Pradesh Reorganisation Act, 2014.
In the NTR University of Health Sciences Act, 1986 (Act No.6 of 1986) throughout the Act, for the expression “Andhra Pradesh”, the word “Telangana” shall be substituted, and there shall also be made in any sentence in which the expression occurs such consequential amendments as the rules of grammar may require.
In sub-section (1) of section 1 and throughout the Act wherever the expression “N.T.R. University of Health Sciences” occurs the expression “Kaloji Narayana Rao University of Health Sciences” shall be substituted and there shall also be made in any sentence in which the expression occurs such consequential amendments as the rules of grammar may require.
In section 6, for sub-section (3), the following shall be substituted, namely:- “(3) with effect on and from the appointed date, all colleges situated in Telangana State and admitted to the privileges of the N.T.R. University of Health Sciences, Vijayawada shall be deemed to have admitted to the privileges of the University.”
For section 8, the following shall be substituted namely:
“8 (1) Notwithstanding anything in the N.T.R. University of Health Sciences Act, 1986 all the colleges and institutions affiliated to N.T.R. University of Health Sciences and located in Telangana State shall, on and from the appointed day i.e. 27/09/2014 be dis-affiliated from the said University and thereupon they shall be deemed to have been affiliated to the University.
(2) Notwithstanding the dis-affiliation of the colleges under sub-section(1) from the N.T.R. University of Health Sciences, University may request the N.T.R. University of Health Sciences for the conduct of the examinations and the declarations of results so far as they relate to the current academic year and it may also request for necessary action in the interest of students to meet any contingency that might arise, as a result of the disaffiliation under sub-section (1).”
For section 12, the following shall be substituted namely:-
“12. The Vice Chancellor shall be appointed by the Chancellor from out of a panel of three names of distinguished educationalists in the field of medicine in the alphabetical order suggested by a Committee consisting of,-
i). a nominee of the Chancellor,
ii). the Principal Secretary/Secretary, H&M Department who shall also be convener of the Committeeiii). a nominee of the Executive Council,
Provided that no employee of the University or Member of any Authority of the University shall be a member of the Committee. Provided further that in exigencies the Government can appoint Vice-Chancellor in casual vacancy temporarily till regular appointment of Vice- Chancellor is made in accordance with the procedure prescribed in this section.
In section 28, the proviso shall be substituted with the following namely: “Provided that where the University intends to borrow money from a bank or Corporation or both exceeding an amount of rupees one crore at a time or an amount of rupees five crores in the aggregate in a year, it shall obtain prior written approval of the Government therefor.”
In the Second Schedule,-
(a). under the heading “The Rector”,
(i). the opening paragraph shall be substituted with the following:
“The terms and conditions governing the emoluments and other matters of services of the Rector shall be as follows:”
(ii). in paragraph 1, for the expression “Rs.6,500 p.m.” the expression “as fixed by the University from time to time” shall be substituted;
(iii). in paragraph 3 for the words “Vijayawada” occurring at two places the word “Headquarters” shall be substituted.
(b) Under the heading “The Registrar”, in paragraph 1 the Second proviso shall be omitted.
(c) Under the heading “The Finance Officer”, in paragraph 3 (b) in the proviso for the words “rupees ten thousand“ the words “rupees twenty five thousand“ shall be substituted.
(d) Under the heading “Executive Council”, in paragraph 1 under the heading “Class II – Other Members” for item (viii) the following shall be substituted: “viii. One Member having proficiency in Allopathic Medicine in the State to be nominated by the Government;”
(e) Under the heading “Academic Senate” in paragraph 7, entries at Sl.Nos.10 and 12 shall be omitted.
(f) Under the heading “Deans of Faculties” in paragraph 11, in the proviso the expression “sixty years” shall be substituted with the expression “fifty eight years”.
